This Agreement is by and between “Client” and Global MedTours LLC “Facilitator”

Global MedTours LLC (GMT) Disclaimer of Warranty and Limitation of Liability

GMT LLC is a medical tourism service firm registered in Texas. GMT assists individuals to get acquainted with qualified medical providers that provide medical treatment and recuperation packages outside of continental United States. GMT will gather public information that will help clients make a more informed decision about medical treatment options outside the United States.

GMT LLC will also provide vacation packages for rest and recuperation either before or after the medical procedure as part of the overall service that is available to clients. In addition GMT will provide local (in city) transportation and sight-seeing services on arrival and through to departure to better assist clients.

GMT LLC is neither a medical referral service nor a medical service provider. We do not endorse, recommend or approve any healthcare provider or travel agency listed on our site nor do we guarantee or warrant the accuracy of the public information disclosed to the Client. We are not medical professional staff and will not advise on any issues relating to medical treatment. We facilitate contact with and provide information about Doctors and Hospitals and their credentials in order for our clients to make informed decisions.

GMT LLC strongly urges clients to thoroughly discuss all medical issues with their medical practitioners in the United States prior to making a decision on medical treatment outside the United States.

This Disclaimer is an essential contractual condition of all contracts accepted by GMT LLC. By executing this Agreement, the client will be deemed to have read and agreed to all conditions and provisions contained in this Disclaimer. Client is agreeing to assume all associated responsibilities for his/her choice of Doctors, Hospitals, Medical Personnel, Health Care Providers or Medical Procedures undertaken when choosing to use GMT as a facilitator.

GMT LLC’s responsibilities under this Agreement:

Organizing and booking Client’s travel, accommodation and vacation arrangements in connection with medical treatment and associated leisure activities sought outside the United States.

Assisting Clients in obtaining medical services as provided in this Agreement.

GMT LLC will provide Clients with obtaining assistance while in country of destination. GMT LLC is not itself a provider of Transport, Accommodation, Tours or Medical Services.

All Transport, Accommodation, Tours and Medical Services will be provided by Third Parties that are independent of GMT LLC. Client acknowledges and agrees that GMT LLC does not warrant the products or services (collectively, “Third Party Products and Services”) provided by Third Parties.

In no event shall GMT, its Principals, Members, Managers, Officers, Directors, Partners, Employees, Affiliates, Successors or Assigns (the “GMT Parties”) be liable to Clients on account of any claim, cause of action, obligation, damage (including, without limitation, personal injury or death and property damage), liability loss, cost or expense (collectively, Losses) arising out of or relating to any Third Party Products or Services. Client has the sole responsibility to check each Third Party’s terms and conditions that apply to the goods or services it provides, including any applicable exclusions or limitations of liability imposed by the Third Party, which may exclude or limit liability for delays, property loss or damage, personal injury or death.

Disclaimer of all Warranties

GMT does not make and hereby expressly disclaims any and all representations and warranties with respect to its services hereunder and the Third Party Products and Services, including without limitation (i) all implied warranties of merchantability and fitness for any particular purpose, (ii) that the Third Party Products and Services will be provided with reasonable care and skill, and (iii) the safety, conditions, standards or other issues that exist at any Third Party’s facility or any travel destination, including locations visited in transit.

Limitations on Liability

Client hereby agrees and acknowledges that no representative of GMT shall have any liability whatsoever for any Losses suffered by the Clients relating to or arising out of any Third Party Products or Services, including but not limited to:

Physical and Psychological injury of whatever nature or
Loss or Damage to Property of whatever nature or
Any Loss of Income/ Profits or
Any Loss of Use or
Any Business Interruption

Client hereby agrees and acknowledges that in the event of any such Losses suffered by Clients relating to or arising out of any Third Party Products or Services, Clients shall look solely to the Third Party that provided such Third Party Product or Service for any applicable remedy or compensation and not to any GMT Party.

Client hereby agrees that no GMT Party shall have any liability for any indirect special, punitive, incidental or consequential damages of any kind whether alleged as a breach of contact or tortuous conduct, including negligence.

In addition to the exclusions from liability set forth above, Clients hereby agree that no GMT Party shall be liable to the Clients for any actions or omissions of GMT except for actions or omissions that constitute gross negligence or willful misconduct.

In all circumstances GMT’s liability to the Client with respect to GMT’s services hereunder shall be limited to, at GMT’s option (i) a full refund of any fees paid to GMT by Clients (except a non refundable fee of $500) including payment for all third party services or (ii) provision of replacement services.

Force Majeure

The obligations of GMT to perform under this Agreement shall be excused during each period of delay and/or inability to perform caused by matters such as strikes, riot, explosion, war, fire, flood, earthquake, tsunami, sabotage, terrorist attack, accident to or failure of machinery or equipment or industrial action, shortages or power or raw material breakdown or unavailability of fuel, labor, or transport facilities, accidents of navigation or breakdown or damage to vessels or other conveyances, other abnormal impediments to transportation, government orders, acts of God, or other causes beyond the reasonable control of GMT. Such matters may or may not be foreseen. GMT will advise Client on political and security situation in the country of visit based on updated public information available at the time of signing the contract and undertaking the travel. However, Client agrees to do his/her own due diligence prior to undertaking travel to the location of their choice.

Client Acknowledgements

Client acknowledges that any and all medical advice, procedures, care or other Medical Services may involve significant risks. Such risks include, without limitation, incorrect medical advice, unsuccessful medical procedures, inadequate medical care, recovery not as per expectation, medical malpractice and personal injury or side effects. It is further acknowledged by Client that the standard of medical advice, medical procedures and medical care generally outside of the United States may be significantly different U.S. standards. Client acknowledges that GMT shall not be obligated to provide or arrange for legal advice or legal representation for Clients as part of GMT’s service hereunder. It is Client’s responsibility to know and respect the laws and customs of the country of destination or a country visited in transit. Client takes full responsibility for consequences arising from violating any laws or cultural mores in the country being visited.

Client acknowledges that GMT assumes NO responsibilities nor grants any warranties, express or implied relating to the Operation, Safety, Condition or Service of any Physician, Health Care Provider, Hospital, Aircraft, Motor Vehicle, Boat, Other Conveyance, Inn or Lodge, Hotel or other products associated with such entities or services that are used wholly or in part by, for or on behalf of the Client.

**WARNING: In some countries, including Thailand and Malaysia, possession of various narcotic drugs can be punishable by life imprisonment or even the death penalty**

Client Representations and Warranties

Client warrants and represents to GMT as follows:

1. Client has received or been advised by GMT to receive, independent medical advice from a qualified medical practitioner regarding the Medical Services;
2. GMT has not given Clients any advice or opinion that a reasonable person would interpret as medical opinion or medical advice (including but not limited to advice regarding health risks or side effects).
   
   

Travel Insurance

GMT will provide comprehensive travel insurance for the entire period of Client’s travel. This service will be offered as part of the Package and cannot be waived by Client. GMT will not be responsible for any Losses or Damages arising out of Client’s failure to provide full disclosure of all relevant matters including elective surgery that will be undertaken during travel.

Privacy Policy

The protection of our users’ personal information is extremely important to us. We do not sell or share your information to any Third Party at any time without your permission.

Use of Internet Site

Use of the Site assumes your understanding and acceptance of the terms and conditions. If you do not agree to all or to any of the Terms of Use and all other policies described in this Site, please do NOT use this site.

By continuing to access, use or browse this site, you indicate that you have read, understood and agree to be bound by these terms and conditions and you understand and intend this User Agreement to be the legal equivalent of a Signed, Written Contract between You and Global MedTours (GMT) LLC. And equally binding.

You may not download, publish, sell, duplicate or use for commercial or any other purpose whatsoever, the information found on this site, in whole or in part without the written permission of GMT LLC. You may not make use of this Site in any way that may be derogatory to us or portray us in a false, misleading or offensive manner. All trademarks, registered trademarks, product names, and company names or logos on or displayed on the Site are the property of either GMT LLC or their respective owners, which have been used here with the express permission of the owners. None of these trademarks may be copied or used without authorization of the appropriate owners

GMT LLC reserves the right to change, modify, add or remove portions of these Terms and Conditions periodically. Such modifications shall be effective immediately upon posting of the modified Agreement to the Website unless provided otherwise.

Your continued use of the website following the posting of changes to these Terms and Conditions will mean that you accept those changes. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the website (or any part thereof). We may impose limits on certain features and services or restrict your access to certain parts or the entire Site without any notice or liability. We may terminate your use of the Site at any time, in our sole discretion, without any notice or liability.

Client/ User agrees that under NO circumstances will GMT or its affiliates or any of its respective Directors, Officers, Members, Proprietors, Partners, Employees, Agents, Representatives, Attorneys, Predecessors, Successors or Assigns be liable for any indirect, incidental, special punitive, exemplary or consequential damages (including but not limited to lost profits and damages that result from inconvenience, delay or loss of use) arising out of the services provided by GMT, including but not limited to GMT’s website, materials, arrangements made based on information obtained through GMT’s website or products and services obtained through GMT’s website.

**The parties agree that any legal action proceeding under or with respect to this Agreement may be bought in the courts of the country where the legal infraction occurred. Client hereby submits to the jurisdiction of such courts. Client hereby agrees not to raise and does waive any objection to or any defense based upon the venue of such courts and any objection or defense based upon an inconvenient forum. Client also agrees not to bring any legal action or proceeding under or with respect to this Agreement outside an area where the legal issue occurred unless, for some reason, the Courts do not have jurisdiction in the matter.**

Travel Documents

All documents issued to you are not transferable. These documents may include but are not limited to hotel and tour vouchers, airline tickets, or other documents for confirmation of an arrangement with a service provider. All participants are responsible for obtaining their own travel documents necessary for travel. We could provide Visa information and other travel regulations if needed.

Cancellations

Standard Cancellation Terms
Because on the special nature of the programs featured on this website, suppliers impose rigid cancellation fees; please be aware that GMT, LLC has no control over such fees and cannot make any exceptions to these charges.
Note: ALL cancellations must be received by GMT, LLC. in writing; cancellation/s will be effective when the written notice is received at GMT, LLC.’s offices in Friendswood, Texas.
If a cancellation is received after GMT, LLC. is in possession of the initial deposit, but more than 60 days prior to departure (or 90 days if applicable), the cancellation fee incurred will be $250 per person (a higher cancellation fee may apply to some tours). If cancellation is received between 59 and 45 days prior to departure the fee incurred will be 25% of the entire tour price. Or, if final payment has been received before 60 days prior to departure, and cancellation occurs, the fee incurred will be 25% of the entire tour price. Cancellation/s received between 44 days and 30 days prior to departure will be charged a fee of 50% of the entire tour price. NO REFUNDS whatsoever will be made for cancellations received within the last 30 days prior to departure.
Airfares are subject to different rules and cancellation fees; some may be non-refundable. Details will be provided at the time of booking. To protect against cancellation charges, we strongly recommend purchasing Cancellation Protection and Travel Interruption Insurance.
